Abstract
Zusammenfassung : Die Internationalen Gesundheitsvorschriften (2005) (IGV) sind das zentrale völkerrechtliche Instrument im Zuständigkeitsbereich der Weltgesundheitsorganisation (WHO) für die Verhütung und Bekämpfung einer grenzüberschreitenden Ausbreitung von Krankheiten. Nach einem 10-jährigen Revisionsprozess hat sich die Völkergemeinschaft auf dieses moderne und flexible Vertragswerk geeinigt, das den Herausforderungen einer globalisierten Welt Rechnung trägt. Seit Juni 2007 sind die IGV für alle Mitgliedsstaaten der WHO völkerrechtlich verbindlich. Sie enthalten weitreichende Rechte und Pflichten der Vertragsstaaten sowie Aufgaben der WHO, die der nationalen und internationalen Surveillance, Risikobewertung sowie Krankheitsverhütung und -bekämpfung dienen. In Bezug auf die Surveillance besteht die zentrale Verplichtung der Vertragsstaaten, Ereignisse, die eine gesundheitliche Notlage von internationaler Tragweite darstellen können, der WHO zu melden. Diese Verpflichtung ist auch auf alle bisher unbekannten Risiken für die öffentliche Gesundheit anzuwenden, und zwar unter Berücksichtigung der jeweiligen Umstände, unter denen ein Ereignis auftritt. Zudem besteht die Forderung an alle Vertragsstaaten nach der Schaffung, Stärkung und Aufrechterhaltung von Strukturen des öffentlichen Gesundheitssystems, die ein effektives Surveillancesystem und die adäquate Reaktion auf Ereignisse, z. B. Krankheitsausbrüche, gewährleisten.
Abstract : The International Health Regulations (IHR 2005) are a legally binding agreement that was adopted by all WHO Member States and which entered into force in June 2007. While taking the challenges of a globalized world into consideration, the purpose of the IHR (2005) is to provide a framework for international efforts to contain or reduce the risk from public health threats that may spread between countries. To this end, the IHR (2005) contain rights and obligations for the States and for WHO concerning national and international surveillance, assessment and public health response. With respect to surveillance, States are required to notify WHO of all events “that may constitute a public health emergency of international concern” according to agreed criteria. This obligation applies to novel or evolving public health risks, taking into account the context in which the event occurs. The IHR (2005) also contain obligations regarding global preparedness to address public health threats which include the establishment of national capacity to both detect and respond to events by June 2012.
